Cops Say Shia's Not to Blame

He's been trying to explore his bad-boy side, what with smoking in the boys' room and riding motorcycles. Speeding all over the place and getting into wrecks in cars. All while pulling off that baby-faced charm. Still, the DUI thing came as a shocker.
And now, in a plot twist, it turns out Shia may not be to blame for the car crash he was in on Sunday in West Hollywood.
While he was apparently intoxicated, according to police reports, "It appears he was not at fault," Los Angeles County Sheriff's spokesman Steve Whitmore told People yesterday. "We have strong evidence that the other driver ran a red light."
Whitmore also told UsMagazine.com that the other driver "will be cited. They will now be listed as Party One on the report, indicating they were at fault."
Shia will still likely be charged with a misdemeanor DUI, as police reports indicate that he had been driving drunk during the time of the incident.
Shia's passenger during the incident, "Transformers 2" costar Isabel Lucas, was not hurt. Nor was the other driver. But poor Shia, who suffered injuries to his head, left hand, and knee, is "currently recovering from extensive hand surgery with plans to return to work on the set of 'Transformers 2' within one month," according to his rep.
